Tree Surgeons Sevenkings Service Terms and Conditions

Tree surgeons preparing to begin professional work on a residential site These Terms and Conditions set out the basis on which Tree Surgeons Sevenkings provides tree surgery and related arboricultural services to domestic and commercial customers. By making a booking, accepting a quotation, or allowing work to proceed, you agree to these terms. They are intended to be clear, fair and practical, while reflecting the standards expected of a professional tree surgeon service operating in the UK.

These terms apply to all work carried out by Tree Surgeons Sevenkings, including pruning, reductions, crown works, dismantling, stump work, site clearance, and associated waste handling. They should be read together with any written quotation, scope of work, or specific site conditions discussed before the start of the job. If there is any inconsistency between these terms and a written agreement signed by both parties, the written agreement will take priority to the extent of that inconsistency.

Arborists carrying out a tree surgery assessment before the job starts We reserve the right to amend these terms from time to time to reflect changes in law, business practice, insurance requirements, or operational needs. The version in force at the time your booking is accepted will normally apply to that job. For recurring or ongoing work, updated terms may apply to future appointments once they have been made available and the customer has been given a reasonable opportunity to review them.

1. Booking Process

Bookings may be made after an initial enquiry, site discussion, remote assessment, or on-site inspection. Because arboricultural work depends heavily on access, tree condition, location, and hazards, quotations may be based on photographs, measurements, or a physical visit. A quotation is an invitation to proceed on the stated scope and price, unless expressed as otherwise. A booking is only confirmed when we have accepted the instruction and, where requested, received any deposit or advance payment.

Professional tree surgery team working safely with equipment on site The customer is responsible for providing accurate information during the booking process, including the location of the trees, whether permission from a landlord, managing agent, or neighbour is required, and whether there are restrictions affecting access or timing. If information supplied is incomplete or inaccurate, we may need to revise the quotation, reschedule the work, or alter the method of work. Any additional costs reasonably arising from incorrect or incomplete information may be charged to the customer.

We may decline or postpone a booking if access is unsafe, the work would breach statutory controls, the tree is subject to protection measures, weather conditions are unsuitable, or the customer has not secured the necessary permissions. Where a tree is covered by a Tree Preservation Order, located in a conservation area, or otherwise subject to legal restrictions, the customer must ensure that the relevant consents or notices are in place before work begins, unless we have expressly agreed to manage that process.

Appointment times are given in good faith but are estimates only. Due to the nature of tree surgery, delays may occur because of weather, traffic, equipment failures, emergency call-outs, or changes in site conditions. We will aim to keep customers informed of any significant delay, but we do not accept liability for loss caused by reasonable rescheduling outside our control. If access is not available at the agreed time, we may charge a call-out or wasted journey fee.

2. Pricing and Payments

All prices are quoted in pounds sterling unless otherwise stated. Unless explicitly described as fixed, quotations are based on the information available at the time and may change if the scope of work changes, unforeseen hazards are discovered, or additional labour, machinery, traffic management, climbing systems, or waste handling are required. Any material variation in price will be explained before extra work proceeds wherever reasonably practicable.

Payment terms may vary depending on the size and type of job. For some projects, full payment is required on completion; for larger works, staged payments or a deposit may be requested in advance. Unless otherwise agreed in writing, invoices are due immediately on completion or within the stated period on the invoice. Late payment may result in additional administrative charges and, where lawful, statutory interest and recovery costs. We may suspend further work on the same or another project if previous invoices remain unpaid.

Tree surgery crew managing a scheduled service and site cleanup Customers must not withhold payment for completed work because of a dispute over a separate issue unless a valid legal basis exists. If any part of the work is disputed, the undisputed portion should still be paid by the due date. Any deduction, set-off, or retention must be agreed in advance or permitted by law. Ownership of any materials supplied remains with us until all sums due have been paid in full.

3. Cancellations and Rescheduling

If you wish to cancel or rearrange a booking, you should notify us as soon as possible. Where a cancellation occurs after preparation has started, or where we have reserved staff, machinery, or specialist equipment for your job, we may charge a reasonable cancellation fee to cover costs already incurred. This may include travel, planning, permits, hired equipment, waste arrangements, or subcontracted support.

Cancellations made at short notice may be charged more heavily if the slot could not reasonably be reallocated. If adverse weather or unsafe site conditions make it impractical to work, we may cancel or defer the appointment without liability. In such circumstances, we will seek to rearrange the work at the earliest reasonable opportunity, subject to availability and any necessary change in the operational plan.

We also reserve the right to pause or terminate work if the site becomes unsafe, if hidden hazards are found, if utilities are identified in a hazardous location, or if the customer or a third party prevents safe completion. In those cases, charges may still apply for work already completed, time spent on site, and any agreed preparatory work.

4. Customer Responsibilities

The customer must ensure that we have safe access to the site and, where needed, parking or unloading space for tools, machinery, and vehicles. Any pets, children, or members of the public should be kept clear of the work area. The customer must also inform us of any underground services, overhead cables, hidden drains, unstable ground, nesting birds, protected species, or other relevant conditions known to them before work begins.

Where the work site includes neighbouring property or shared access, the customer is responsible for obtaining permissions and making suitable arrangements unless we have agreed in writing to assist. Customers should remove or secure fragile items, garden furniture, vehicles, ornaments, and other property that may be affected by falling debris, sawdust, or movement of equipment. We will take reasonable care, but we are not responsible for damage caused by a customer’s failure to protect items that were reasonably within their control.

5. Liability and Insurance

We will carry out our work with reasonable skill and care, using trained staff and appropriate equipment. However, tree surgery is inherently risky, and outcomes can be affected by tree condition, hidden defects, weather, and site constraints. Unless otherwise required by law, we do not guarantee a particular visual result, regrowth pattern, or future stability outcome, especially where the tree is structurally compromised before work begins.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under UK law. Subject to that, our liability for direct loss or damage arising from our negligence, breach of contract, or breach of statutory duty is limited to the amount paid or payable for the specific service giving rise to the claim, except where a higher limit is required by law or agreed in writing.

Tree surgeons completing a lawful waste removal and site clearance job We are not liable for indirect or consequential losses, including loss of profit, loss of business, loss of enjoyment, or loss arising from delays beyond our reasonable control. We are also not responsible for pre-existing defects, hidden decay, structural instability, or failures caused by natural causes unless directly and solely caused by our negligent act or omission. Customers are advised to notify us promptly of any alleged damage so that it can be inspected and, where appropriate, reported to our insurer.

6. Waste Handling and Environmental Compliance

All green waste, timber, brash, woodchips, and similar arisings created during the service will be handled in accordance with applicable waste regulations and environmental law. Unless agreed otherwise, waste removal will be included or charged as specified in the quotation. We may transport waste to licensed facilities, reuse suitable material where lawful and appropriate, or leave agreed timber on site if that has been arranged in advance.

Customers must not instruct us to dispose of waste illegally, burn material contrary to local restrictions, or leave arisings in a condition that breaches environmental rules. We will not carry out any activity that would conflict with our obligations under waste duty of care requirements. If the customer asks to retain wood or green waste, they accept responsibility for its storage, onward use, and legal disposal after handover, unless we expressly agree otherwise.

Where permits, skip arrangements, traffic controls, or other waste-related measures are needed, these must be agreed before work begins. Any additional fees or compliance costs arising from site-specific waste handling requirements may be added to the price with notice. We aim to minimise waste and operate responsibly, but the customer acknowledges that the volume and nature of arboricultural waste can be difficult to predict exactly in advance.

7. Site Safety and Method Changes

Our team may alter the method of work if the original plan becomes unsafe or impractical. This may include changing from climbing to mechanical access, adjusting the sequence of dismantling, or leaving certain sections of a tree in place temporarily. Any such changes will be made with safety as the first priority. If a revised method causes a material price change, we will explain the reason before proceeding where possible.

Customers acknowledge that tree surgery may involve cutting, lowering, rigging, stump work, use of chainsaws, chippers, lifting equipment, and other specialist tools. The presence of such equipment does not create a guarantee that every part of the site will remain free from debris or disturbance. Normal signs of professional work, including tracked movement across lawns or temporary access marks, may be unavoidable.

8. Complaints and Rectification

If you believe the service has not been carried out in accordance with the agreed scope, you should notify us promptly and provide reasonable details. We may ask for photographs, access to the site, or the opportunity to inspect the work. Where a legitimate issue exists and we are responsible, we may choose to rectify the matter, reduce the charge, or offer another reasonable remedy in line with our legal obligations.

We will not usually be responsible for issues that arise because of weather after completion, natural regrowth, or changes caused by third parties. Any request for further pruning, shaping, stump treatment, or clearance after the original service may be treated as a separate job and quoted separately. Complaints must be made in good faith and within a reasonable time after the work has been completed.

9. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including severe weather, storms, flooding, fire, industrial action, equipment shortages, road closures, utility failures, acts of authority, epidemics, or emergencies. If such an event affects performance, we may suspend the service, adapt the booking, or cancel the affected part of the work without liability for losses arising from the delay.

10. Governing Law

These Terms and Conditions, and any dispute or claim arising from them or in connection with the services provided by Tree Surgeons Sevenkings, are governed by the laws of England and Wales. The parties agree that the courts of England and Wales shall have exclusive jurisdiction, subject to any mandatory consumer rights or statutory protections that apply.

If any provision of these terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will continue in full force and effect. Failure by us to enforce any right or provision on one occasion will not be treated as a waiver of that right or any other right on another occasion. These terms are intended to operate alongside applicable UK consumer law, contract law, health and safety requirements, and environmental legislation.

11. General Provisions

Any notice relating to these terms should be given in a reasonable and durable form, such as writing, and should clearly identify the booking or job concerned. Headings are included for convenience only and do not affect interpretation. References to “we”, “us”, and “our” mean the service provider operating under the name Tree Surgeons Sevenkings, and references to “you” or “the customer” mean the person or organisation purchasing the service.
